These Terms of Service ("Terms") govern your use of the62agency.com (the "Site"), operated by Sixty Two Media LLC, doing business as The 62 Agency ("The 62 Agency," "we," "us," or "our"). By using the Site, you agree to these Terms.
1. Acceptance of these Terms
By accessing or using the Site, or submitting a form, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.
2. What we do
The 62 Agency provides AI-powered phone answering, lead-capture, and follow-up systems for local service businesses, including an AI front desk that answers calls, missed-call text-back, appointment booking, CRM and follow-up automation, review and reputation tools, and related add-ons. Information on the Site (including package descriptions and prices) is for general information and does not by itself create a contract. The specific scope, pricing, and terms of any services we provide are set out in a separate service agreement.
3. Inquiries
Contacting us does not obligate you to purchase anything, and does not obligate us to provide services. Any engagement begins only when both parties agree to a separate service agreement.
4. Use of the Site
You agree to use the Site only for lawful purposes. You will not:
Use the Site in any way that violates applicable law;
Attempt to gain unauthorized access to the Site, its servers, or connected systems;
Interfere with or disrupt the Site or its security;
Copy, scrape, or misuse content from the Site without our permission.
5. Intellectual property
The Site and its content, including text, graphics, logos, the "The 62 Agency" name, and design, are owned by or licensed to Sixty Two Media LLC and are protected by intellectual-property laws. You may not use, copy, or reproduce our content or branding without our written permission.
6. SMS / text messaging terms
By providing your phone number and checking the applicable consent box on our forms, you agree we may contact you by text message. Consent to receive texts is not a condition of any purchase. These terms govern our SMS program:
• Program. The SMS messaging program is operated by Sixty Two Media LLC (The 62 Agency). By opting in, you may receive transactional messages about
your inquiry, appointment confirmations and reminders, and service updates, and, only if you separately consent, occasional promotional messages.
• Message frequency. Message frequency varies.
• Age requirement. You must be at least 18 years old to opt in to our SMS program. By providing your phone number and consenting, you confirm that you are
18 or older.
• Opt out. Reply STOP at any time to cancel. After you send STOP, we will send one confirmation message, and you will receive no further texts from us.
• Rejoin. To start receiving messages again after opting out, opt in the same way you did originally (check the consent box on our form).

• Carrier liability. Carriers are not liable for delayed or undelivered messages.
• Message and data rates. Message and data rates may apply. For questions about your text or data plan, contact your wireless provider.

• Industry standards. Our messaging program is operated in accordance with applicable carrier requirements, CTIA guidelines, and applicable law.
You can opt out of marketing emails at any time using the unsubscribe link in any email.
7. Third-party services and links
The Site may rely on or link to third-party platforms and websites (for example, our CRM and messaging providers). We are not responsible for the content, policies, or practices of third parties.
8. Disclaimers
The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or secure. Any results, examples, or estimates described on the Site are illustrative and are not a guarantee of specific outcomes; results depend on many factors outside our control.
9. Limitation of liability
To the fullest extent permitted by law, Sixty Two Media LLC and The 62 Agency will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of your use of the Site. Our total liability relating to the Site will not exceed one hundred dollars ($100). Services we provide under a separate agreement are governed by the liability terms in that agreement.
10. Indemnification
You agree to indemnify and hold harmless Sixty Two Media LLC and The 62 Agency from any claims, damages, or expenses arising out of your misuse of the Site or violation of these Terms.
11. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Any dispute relating to the Site will be handled in the state or federal courts located in Arizona.
12. Changes to these Terms
We may update these Terms from time to time. The "Effective date" above shows when they were last revised. Continued use of the Site after changes means you accept the updated Terms.
